General terms

These Sale Terms and Conditions shall apply to all contracts entered into by EXEMPLAIRE ("we or us" "EXEMPLAIRE SAS") registered in France under n° 539 769 604, whose office is at 334 rue Saint-Honoré, 75001 PARIS. By placing your order on our web site www.exemplaire.com, you are accepting these Terms and Conditions. The company reserves the right to modify these terms and conditions at any time.

1 - Object

The present conditions govern the sales by the company EXEMPLAIRE SAS of the products of the mark EXEMPLAIRE (luxury ready-to-wear and leather goods for men).

2 - Orders

Our web site allows our customers to order a selection of EXEMPLAIRE branded products directly online at EXEMPLAIRE SAS company, for delivery to the countries mentioned in the list of delivery. You can also order by phone at +33 1 42 61 35 17 from Monday to Saturday (excluding holidays) from 10.00 am to 7.00 pm. or by email at contact@exemplaire.com.

All the products on our web site can be purchased until they are visible on the site, within the limits of available stocks. Errors or changes may exceptionally exist, especially in the case of simultaneous orders of the same product by several customers. However if a product is unavailable after placing your order, we will notify you by email or phone as soon as possible, offering you to order another article featured on our website for replacing it, or cancel your order. If you choose to cancel your order, you will be reimbursed if your account was debited.

We took a lot of care in the preparation of the content of our website, in particular to ensure that prices quoted are accurate at the time of posting the product on the website and that all products are fairly described. However, your order may not be accepted if there are material errors in the description of the goods you have ordered or their prices. All prices and offers are subject to change.

We have aimed to ensure that the colors of our products appearing on our website are as near as possible to the color of the product. However, the actual color you see will depend on your computer equipment, and accordingly, we are unable to guarantee the precise color of the product on delivery.

To finalize your order, you must click on "Confirm the paiement". Any internet order requires that you provide accurate and complete information about yourself : your title, name, phone, email address, billing address and delivery. Your order will be accepted by us by way of a confirmatory e-mail ('Confirmation of Order') which will confirm that we are able to send you the goods you have ordered, and their price, to the delivery address you have indicated. This Confirmation of Order shall contain all of the information regarding the goods you have ordered. You must check the details contained inside and contact us immediately if an error has occurred.

We advise you to print and keep a copy of it. We reserve the right in our absolute discretion to accept or reject any offer.

3 - Price

EXEMPLAIRE SAS reserves the right to modify at any time and without notice the prices of products offered on the site www.exemplaire.com. Products are invoiced on the basis of the rates posted on the site at the time of placing your order

Payment

The prices of our products are indicated in euros. All the orders whatever their origin are payable in Euros. Payments can be made via a credit card. We accept CB, Visa, Mastercard and American Express. You can't use the customer assets, or gift vouchers issued by EXEMPLAIRE stores to make a purchase on the site www.exemplaire.com.

EXEMPLAIRE SAS doesn't keep or store any financial information about its customers on its server or at its office EXEMPLAIRE SAS has chosen Ingenico a leading and secure service provider for the processing of online payments. EXEMPLAIRE SAS may contact you and may require you to provide additional information in order to prevent any act of fraud.

Duties and taxes

Delivery in France and countries belonging to the European Union (EU)

The order will be established TTC. The prices include the VAT applicable on the day of the order. Any rate change will be reflected on the price of products.

These times are indicative and are subject to variations in particular during periods of high demand. We will aim to dispatch the goods ordered by you, as soon as possible after your order has been accepted by us, to the postal address you have given in your order. However, we cannot guarantee an exact delivery date and your goods may take longer to be dispatched if the products you have ordered are not in stock at the time of placing your order or they are to be dispatched to an address outside of France.

Our shipping service provider will send you an email with the tracking number and the delivery date for your order. For any further information on your delivery, you will have to connect to our shipping service provider's web site

Delivery can only be made if agreed by the client and the payment center of Ingenico (payment agreement). EXEMPLAIRE SAS reserves the right to refuse any order from a customer with whom there is a dispute over payment of a previous or in progress order.

EXEMPLAIRE SAS can't be held responsible for any direct or indirect consequences of an order cancellation or delay in delivery for any reason whatsoever and in particular in case of disruption or postal strike or transport and in general, in case of events beyond our control. The delivery time is provided for information purposes only and any overshoot will not give rise to any damages, refusal of delivery or cancel the order

Any delivery delay over 8 days should be reported to our customer service. Any claim made beyond one month after the date of confirmation of your order will not be taken into account

Please note that we can't deliver any order sent to a PO Box, our provider can't provide this service.

4 - Delivery costs and time

For the moment, we ship from France to a limited number of countries and this is handled by UPS.

All exemplaire.com orders are gift wrapped in signature packaging and shipped securely in a cardboard box.

Switzerland

For Switzerland, the orders will be delivered with UPS services, within a period of 1 to 4 business days. The delivery costs will be 20 euros per order for a Standard delivery or 40 euros per order for an Express delivery, taxes and customs duties not included.

EU countries

The orders to EU will be delivered with UPS services, within a period of 1 to 6 business days. The delivery costs will be 20 euros per order for a Standard delivery or 40 euros per order for an Express delivery, taxes and customs duties not included.

Other countries in the world

The orders to all other countries listed on our web site will be delivered with UPS services, within a period of 1 to 5 business days. The delivery costs will be 40 euros per order, taxes and custom duties not included.

5 - Return and replacement policy

Return and exchange dates

If you are not satisfied with an item that you have purchased, we will offer a refund or exchange on an unworn, undamaged item within 14 days of it being received by you.

Before returning any product you must obtain a Return Merchandise Authorization (RMA) to be included on the return package. You obtain your RMA and UPS prepaid label by emailing your request to contact@exemplaire.com

Please indicate in your email the reason why the goods are being returned. All returns goods should be in perfect conditions and must be accompanied by a delivery note (this comes with the delivery of your goods). You must indicate the RMA number on the package and use the prepaid UPS return label. Then you have to contact UPS to arrange the pick up and return. We are unable to refund items which are lost. All goods shall remain your responsibility until we receive them in our office.

We normally process returns within 3 working days from receipt in our shop. In periods of high activity, this may take up to 14 working days. Once your refund has been accepted, we will send you a confirmation email.

Refunds will be made on items returned in accordance with the above instructions. In case of anomalies, the package will be returned to you.

All returns must be made from the country where the order was placed, due to merchandising restrictions.

Article exchange is possible only if the product is available in another size or color.

Return address and shipping charges

Exchange

Exchanges are subject to product availability and must be within 14 days of the date of purchase. Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check. Return shipping charges must be covered by the customer. Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Union (EU).

Money refund

Only items properly returned under this policy are eligible for a refund. If you choose a refund, the full purchase price (shipping, taxes and customs duties excluded) will be credited to your credit card, when we have received and processed your return, ( typically , within 7-10 business days after we have received the item in our office).

Defective product

If you received a defective item, or damaged during shipping, please contact our customer service immediately (within 48 hours from delivery). Please supply your order number from the original confirmation email, your email address and your phone number. We will make every reasonable effort to replace the item in a timely manner. If there is extensive damage to the carton, refuse the order and contact our customer service immediately at contact@exemplaire.com. or by phone at +33(0)1 42 61 35 17.

We won't ask you to pay shipping costs again in case of exchange. All refunds will be made within 15 days after the return of the parcel. To request a refund, we thank you for your redefine credit card number. For countries outside the European Union, thank you to specify to customs that it is a "return for non-compliance".

6 - Copyright

All the bags, texts, comments, works, illustrations and pictures reproduced on the website www.exemplaire.com are reserved for the title of the royalty and intellectual document of title, worldwide. Any other use is constitutive of counterfeit and sanctioned with the Intellectual document of title except preliminary authorization of EXEMPLAIRE SAS. Any reproduction total or partial of the catalogue of www.exemplaire.com is strictly prohibited.

7 - Privacy policy

All personal information you supply to us will be treated in accordance with French Data Protection Act dated January 6th 1978, you have a right of access, of correction and opposition to the personnel data concerning yourself. The nature of this site means that we will obtain, use and disclose certain information about you ("Data"). By registering to use the Site you agree to this Use.

We endeavor to take all reasonable steps to protect your personal Data including the use of encryption technology when using the Paybox secured payment service, but cannot guarantee the security of any Data you disclose online. You accept the inherent security implications of being and transacting online over the Internet and will not hold us responsible for any breach of security unless we have been negligent.

8 - Responsibility

The offered products are in conformity with the French legislation into force. It rests with to you to check near the local authorities the possibilities of import or use of the products that your plan to order. EXEMPLAIRE SAS could not be held for person in charge for the inexecution of the contract concluded in the event of unavailability or out-of-stock condition of the product, of cause beyond control, disturbance or all-out strike or partial in particular of the mail service and means of transport and/or communications, flood, fire. EXEMPLAIRE SAS will not incur any responsibility for all consequential damages because of present, trading loss, loss of profit, loss of chance, damage or expenses.

This contract is subjected to the French law. The language of this contract is the French language. In the event of complaint, the French courts will be only qualified.
